Do LLCs Need General Liability Insurance in California?

Forming an LLC protects your personal assets -- but it doesn't protect your business from lawsuits. Here's why California LLCs still need general liability insurance and what it covers.

What an LLC Actually Protects You From

A limited liability company (LLC) creates a legal separation between you and your business. If your business is sued and loses, the judgment is against the business entity -- not against your personal bank account, home, or car. That protection is real and valuable.

But here's what the LLC does not do: it doesn't prevent lawsuits from happening. It doesn't pay for your legal defense. It doesn't compensate the person who was injured or whose property was damaged. And if your business has no assets to cover a judgment, the LLC structure doesn't help much -- there just isn't anything to protect your business from paying.

That's where general liability insurance comes in.

What CGL Insurance Covers for California LLCs

A commercial general liability policy covers your LLC when a third party ( a customer, vendor, visitor, or member of the public ) claims your business caused them harm.

Bodily injury pays when someone is physically injured due to your operations. A customer trips at your location. A passerby is hit by falling material at your job site. A vendor gets hurt on your premises. The policy pays for their medical costs, lost wages, and legal defense if they sue your LLC.

Property damage pays when you accidentally damage someone else's property. Your technician breaks a client's equipment. Your pressure washing operation damages a neighboring vehicle. Your crew scratches a client's flooring during a project. These are property damage claims against your LLC.

Personal and advertising injury covers non-physical harm caused by your business communications -- defamation, copyright infringement in advertising, or misappropriation of someone's name or likeness.

Legal defense costs are included regardless of whether the claim has merit. This is often the most valuable part of the policy -- a frivolous lawsuit can still cost $20,000–$50,000 to defend before it's dismissed.

Does California Law Require General Liability for LLCs?

California doesn't have a blanket state law requiring all LLCs to carry general liability insurance. But in practice, most California LLCs that do any of the following will be required to show proof of coverage:

  • Hold a contractor's license: the California CSLB requires proof of insurance for licensed contractors, including sole proprietor LLCs
  • Sign a commercial lease: nearly all commercial landlords in California require tenant liability insurance as a lease condition
  • Work with commercial clients: enterprise, municipal, and government clients routinely require $1M–$2M in general liability coverage from any vendor or subcontractor
  • Apply for permits: many cities in Los Angeles County require a COI when pulling trade permits

The LLC + CGL Combination

Think of the LLC and the general liability policy as complementary layers of protection:

The LLC protects your personal assets from business liabilities. The CGL policy protects your business assets from third-party claims. Without both, you have gaps.

An LLC with no insurance can still be wiped out by a single lawsuit. A business with insurance but no LLC exposes the owner's personal assets to claims that exceed the policy limits. Together, they create the protection most small business owners in California actually need.

How Much Does It Cost for a California LLC?

For most small California LLCs, a standard $1M/$2M commercial general liability policy runs between $38 and $150 per month. The main cost factors are:

  • Type of business: contractors pay more than consultants; higher-risk trades cost more
  • Annual gross revenue: rates scale with revenue
  • Number of employees: sole-member LLCs pay less than those with crews
  • Claims history: prior claims increase rates
  • Location: Southeast LA County rates are competitive

A sole-member LLC doing consulting or professional services can often find coverage under $50/month. A single-member contractor LLC doing general construction will typically pay $80–$150/month.

Getting a Certificate of Insurance for Your LLC

Many clients and landlords don't just want proof that you have insurance -- they want to be listed on your policy as an additional insured. A CGL policy allows you to add additional insureds at no or low cost, and a certificate of insurance (COI) can be issued the same day your policy is active.

For California LLCs in Santa Fe Springs, Norwalk, Downey, Whittier, Long Beach, and surrounding Southeast LA communities, same-day COI issuance is standard practice for active policies.
